A foreigner can buy a home in Da Nang in their own name, but not any home and not forever. Below are the rules in force on 1 October 2026, the taxes on a purchase and how the deal goes. Our agent finds a property for your budget and area: she works with sales as well as rentals.

What a foreigner can buy

The rules come from Housing Law 27/2023/QH15, in force since 1 August 2024, and Government Decree 95/2024/NĐ-CP.

  • An apartment in a commercial housing project. Projects in defence and security zones are closed to foreigners.
  • A house or villa, again only inside a project.
  • A house on an ordinary street outside a project, or land, cannot be bought by a foreigner.

The buyer has to be in Vietnam legally: on the day the deal is signed you need a valid passport with an entry stamp. Diplomats with immunity cannot buy under these rules.

Quota and ownership term

Foreigners together may own no more than 30 percent of the apartments in one building. For separate houses the cap is 250 houses in an area with the population of one ward. If a building's quota is used up, you cannot register an apartment there in your name, so the quota is checked before the deposit.

Ownership lasts up to 50 years from the date the ownership certificate is issued. On request it can be extended once, for up to 50 more years. A foreigner married to a Vietnamese citizen and living in Vietnam owns without a time limit, like a citizen.

The new Personal Income Tax Law 109/2025/QH15 kept the 2% rate, and the 0.5% fee is set by Decree 10/2022/NĐ-CP. When you buy a new apartment from a developer, the terms and payments are in the developer's contract, so read it before you sign.

How the purchase goes

  1. You tell us what you are looking for: budget, area, type of home, to live in or to let.
  2. The agent sends options and arranges viewings.
  3. Before the deposit, the seller's ownership certificate, the building's foreign quota and any mortgage or dispute on the property are checked.
  4. A sale contract between private individuals is certified by a notary.
  5. After payment and registration, the certificate is issued in your name.

Buying to let

A foreigner can let the apartment they bought. The law requires written notice to the housing authority before letting it, and rental income is taxed. A private landlord with rental income up to 1 billion dong a year pays no tax; this threshold applies from 2026.
